and new associate members to the Council. The question at issue is whether we should have Germany in. 2. Cabinet yesterday agreed that I should take the following line at the Committee of Ministers on the 3rd November: (a) That the Committee should make a declaration that, if the German Federal Republic desires to accede as an associate member and is prepared to subscribe to the provisions of Article 3 of the Statute, the Governments concerned will at once issue an invitation to it under Article 5.s (b) That the Committee should make a similar declaration in respect of the Saar, on the assumption that such action will be necessary in order to induce the French Government to agree to (a) above. (c) That the Committee should postpone a decision regarding the admission of Austria until the fate of the peace treaty negotiations is clearer. 3. It seems to us that since the Council of Europe is a focus for European co¬ operation and we have promised to incorporate Germany into the Western system, the Council is the most suitable body with which to begin the process. We think she should be invited as an associate member and not as a full member since she does not as yet control her foreign policy and we have information to the effect that the German Chancellor would be perfectly happy with associate membership. Moreover, it is most unlikely that the French would agree to full membership now. 4. We do not think there is a chance of the French agreeing even to associate membership for Germany unless a similar move is made for the Saar. We feel we must do something to break the deadlock. Consequently provided that we manage to induce the French to say that, just as in the case of Germany, they would have no objection to the Saar eventually joining as a full member, we feel that we should agree with the French view that it should have associate membership now. For if the Saar ever should join as a full member it will be clear that as an independent State it would possess the inherent right of eventually choosing between remaining x Die Quellen beziehen sich auf folgende Artikel der Satzung des Europarates vom 5.5.1949: „Kapitel I. Art. 1: a) der Europarat hat zur Aufgabe, eine engere Verbindung zwischen seinen Mitgliedern zum Schutze und zur Förderung der Ideale und Grundsätze, die ihr gemeinsames Erbe bilden, herzustellen und ihren wirtschaftlichen und sozialen Fortschritt zu fördern, b) Diese Aufgabe wird von den Organen des Rates erfüllt durch die Beratung von Fragen von gemeinsamem Interesse, durch den Abschluß von Abkommen und durch gemeinschaftliches Vorgehen auf wirtschaftlichem, sozialem, kulturellem und wissenschaftlichem Gebiet und auf den Gebieten des Rechts und der Verwaltung sowie durch den Schutz und die Fortentwicklung der Menschenrechte und Grundfreiheiten. [...] Kapitel II. Zusammensetzung. [...] Art. 3: Jedes Mitglied des Europarates erkennt den Grundsatz der Vorherrschaft des Rechts und den Grundsatz an, daß jeder, der seiner Hoheitsgewalt unterliegt, der Menschenrechte und Grundfreiheiten teilhaftig werden soll. Es verpflichtet sich, bei der Erfüllung der in Kapitel I bestimmten Aufgaben aufrichtig und tatkräftig mitzuarbeiten.“ Art. 5 regelt die Prozeduren für die Aufnahme assoziierter Mitglieder.
